 Post subject: Damaged Live Oak Tree

We just moved into a new house on the north side of Fort Worth and the Live Oak tree that I fought so hard for (they were gonna plant a Bradford Pear) is damaged. It has wind burn from the trip and four of the branches are broken. The tree is about 12 feet tall. They also placed a pile of mulch at the base that is about six inches high and goes all the way the base - this is wrong, right? Should I just use the sick tree treatment with the poor thing and try to get it back in good health? I tried to ask for a replacement but they said if they have to replace this one I am stuck with a Pear.

How many branches does the tree have, and what part of the branches were broken? Were they completely broken off? What size are the branches that were damaged? If it were me, I would probably just let it be and see if it recovers. As for the mulch, I don't put thick mulch around the base of any tree. I leave the base exposed, and if I want mulch, I move out away from the base and place it, but honestly, I wouldn't' think mulch is necessary for a live oak. They are pretty tough trees unless they have a case of blight or decline.
